1.1 Information you give us. Depending on how you interact with us, we collect:
- Contact details: name, mailing address, phone number, and email address.
- Order information: billing and shipping addresses, payment confirmation, items purchased, and Subscription details. Our payment processors collect your full payment card details; we do not store them.
- Account information: username, password, and account preferences.
- Shopping information: items you view, add to your cart, or save.
- Communications: messages you send us, including customer support requests, reviews, survey responses, and anything you choose to include in them.
- Marketing preferences: your email and text message subscriptions and records of your consent.
1.2 Information collected automatically. When you use the Services, open our emails, or interact with our ads, we and our partners automatically collect information using cookies, pixels, software development kits, and similar technologies ("Cookies"). This includes your IP address, approximate location derived from it, device and browser type, operating system, pages you view, links you click, referring websites, time spent on pages, and how you interact with our emails and ads ("Usage Data").
1.3 Information from third parties. We receive information from service providers and partners that support our business, including Shopify (our e-commerce platform), Seal Subscriptions (subscription management), Klaviyo (email and text messaging), Meta, Google, and TikTok (advertising and analytics), Triple Whale (marketing analytics), Loox (reviews), Goaffpro (affiliate program), and our payment processors.
1.4 Mobile app and device data. When our mobile app becomes available and you use it with your Oralucent toothbrush, we will collect information from the app and the toothbrush, including brushing sessions (date, time, duration, and mode), light-therapy usage, device settings, battery and performance data, error logs, toothbrush and phone identifiers, and Bluetooth connection data. We will describe any additional app data in the app before we collect it. We do not collect precise geolocation through the app.
Section 2 – How We Use Information
We use personal information to:
- Provide products and Services: process payments, fulfill orders and Subscriptions, arrange shipping, handle returns and warranty claims, manage your account, and send transactional messages about your orders, Subscriptions, and account.
- Market and advertise: send marketing emails, text messages, and postal mail; show you ads on our Site and on other websites and apps; and measure how well our marketing works.
- Operate the mobile app: pair and connect your toothbrush, show your brushing history, provide reminders and features in the app, and diagnose device problems.
- Develop and train artificial intelligence (AI): see Section 2.1.
- Provide customer support: respond to your questions and requests.
- Improve our products and Services: analyze how our Site, app, and products are used.
- Protect our business: detect and prevent fraud, abuse, and security incidents, and enforce our Terms of Service.
- Comply with law: meet legal, tax, and accounting obligations and respond to lawful requests.
2.1 AI development and training. We use personal information to develop, train, and improve AI systems that support our business, including customer support tools, personalized recommendations, and analysis of how our products are used. Information we may use for this purpose includes customer support communications, purchase and Subscription history, Usage Data, and, once our mobile app is available, app and device data. Where we can do so and still meet the purpose, we de-identify or aggregate information before using it. We require service providers that help us build these systems to protect the information and use it only for our purposes.
Section 3 – Health-Related Information
3.1 You do not need to provide health information to buy our products. If you choose to send us health information, such as a Letter of Medical Necessity for HSA or FSA purposes, we use it only to respond to your request. We do not use it for advertising or share it with advertising partners.
3.2 Our advertising and analytics partners' Cookies operate on all pages of our Site, including pages about oral health topics, research, and HSA/FSA eligibility. Those partners receive Usage Data about the pages you visit, as described in Sections 5 and 6. You can opt out as described in Section 7.
3.3 Brushing and device data from our mobile app may be considered consumer health data under some state laws. Before we collect it, we will ask for your consent in the app and provide any additional notice those laws require.
Section 4 – Text Messages
If you opt in to our text messages, we collect your mobile number and a record of your consent. We do not sell, rent, or share your mobile number or text message opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. Our messaging service providers process this information only to deliver messages on our behalf. Text messages are also governed by Section 14 of our Terms of Service.
Section 5 – How We Disclose Information
5.1 We disclose personal information to:
- Service providers that perform services for us, such as e-commerce hosting, payment processing, subscription management, fulfillment and shipping, customer support, email and text messaging, analytics, cloud storage, AI development, and affiliate program management. They may use the information only to provide services to us.
- Advertising and analytics partners, such as Meta, Google, TikTok, and Shopify, that use Cookies on our Site and information we provide to show you ads and measure their results. These partners use the information under their own privacy policies. See Section 7 to opt out.
- Others at your direction, such as when you ask us to ship to someone else or use a social media login or sharing feature.
- Affiliates within our corporate group.
- Parties to a business transaction, such as a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
- Government authorities and others when required by law, such as in response to a subpoena, or when needed to enforce our Terms of Service or protect our rights, our customers, or others.

Section 6 – Cookies and Pixels
6.1 We use Cookies to run the Site (for example, to keep items in your cart), remember your preferences, analyze how the Services are used, and support advertising. We also allow advertising and analytics partners to place their own Cookies on our Site on every page, so they can show you ads on other websites and apps and measure results.
6.2 You can set your browser to block or delete Cookies. Blocking Cookies may cause parts of the Site to stop working, and it may not stop all collection by advertising partners. To opt out of advertising-related collection, use the options in Section 7.
Section 7 – Your Privacy Choices
7.1 Opting out of sales, sharing, and targeted advertising. We allow advertising partners such as Meta, Google, and TikTok to collect information through Cookies on our Site so they can show you ads on other websites. Under some state laws this may be a "sale" or "sharing" of personal information, or "targeted advertising." You can opt out at any time by clicking Your Privacy Choices in the footer of our Site, or by enabling a Global Privacy Control (GPC) signal in your browser, which we treat as a valid opt-out request for that browser. Opting out does not stop all ads; you may still see ads that are not based on your activity.
7.2 Marketing messages. You can unsubscribe from marketing emails using the link in any email, and stop text messages by replying STOP. You will still receive transactional messages about your orders, Subscriptions, and account.
Section 8 – Your Privacy Rights
8.1 Your rights. Wherever you live in the United States, you may ask us to:
- confirm whether we process your personal information and give you access to it;
- correct inaccurate personal information;
- delete your personal information, subject to exceptions allowed by law;
- give you a portable copy of your personal information; and
- opt out of sales, sharing, and targeted advertising (see Section 7).
8.2 How to make a request. Email customercare@oralucent.com with the subject "Privacy Request," or write to us at the address in Section 16. We will verify your identity by matching information you provide with information we already hold. An authorized agent may submit a request on your behalf with your signed permission; we may ask you to confirm your identity directly.
8.3 Our response. We will respond within 45 days. If we need more time, we may extend that period once by up to 45 days where the law permits, and we will tell you why. We will not discriminate against you for exercising your rights.
8.4 Appeals. If we deny your request in whole or in part, you may appeal by replying to our decision with the subject "Privacy Appeal." We will respond to your appeal within the time required by the law of your state. If you are not satisfied with the outcome, you may contact your state attorney general.
Section 9 – Notice of Financial Incentive
9.1 What we offer. We offer a discount on your next order when you sign up for our marketing emails or text messages. The amount and terms of the discount are shown in the signup offer.
9.2 What we collect. To provide the discount, we collect your email address or mobile number, records of your consent, and information about how you use the discount and interact with our marketing messages.
9.3 How to join and withdraw. You join by submitting your email address or mobile number through a signup form and agreeing to the offer terms. Participation is voluntary. You may withdraw at any time by unsubscribing from emails or replying STOP to text messages. Withdrawing does not cancel a discount you have already received.
9.4 Value of your information. We estimate the value of the personal information you provide in connection with this offer as equal to the value of the discount, based on our reasonable estimate of the expected additional purchases and marketing benefit we receive from subscribers.
Section 10 – Data Retention
We keep personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, including to meet legal, tax, and accounting requirements, resolve disputes, and enforce our agreements. In general:
| Category | How long we keep it |
|---|---|
| Order, payment, and tax records | 7 years after the transaction |
| Account information | While your account is active, and up to 2 years after your last activity |
| Subscription and automatic-renewal consent records | At least 3 years, or 1 year after the Subscription ends, whichever is longer |
| Marketing preferences and consent records | While you are subscribed, and up to 4 years after you unsubscribe |
| Customer support communications | 3 years after the issue is resolved |
| Usage Data from Cookies | Up to 2 years |
| App and device data (once the app launches) | While your account is active, unless you delete it sooner |
When information is no longer needed, we delete it or de-identify it so it can no longer reasonably be linked to you.
Section 11 – Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption of data in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you have an account, keep your login credentials confidential and contact us promptly if you believe your account has been compromised.
Section 12 – Reviews and Public Content
If you post a review or other content in a public area of the Services, it will be visible to anyone, along with the name or username you submit it under. We cannot control how others use information you make public. How we use reviews is described in Section 12 of our Terms of Service.
Section 13 – Third-Party Websites and Services
The Services link to websites, platforms, and social media services operated by third parties. Their privacy practices are governed by their own policies, not this one. Information you share on third-party platforms may be visible to other users of those platforms.
Section 14 – Children
The Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us personal information, contact us at customercare@oralucent.com and we will delete it.
Section 15 – Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page and change the "Last Updated" date. If we make a material change, including a new use of personal information you previously provided, we will notify you by email or by a prominent notice on the Site before the change takes effect, and obtain your consent where the law requires.
