Terms of service

Last Updated: October 13, 2026

PLEASE READ SECTION 19 CAREFULLY. IT REQUIRES MOST DISPUTES BETWEEN YOU AND ORALUCENT TO BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 19.8.

IF YOU PURCHASE A SUBSCRIPTION, SECTION 7 EXPLAINS HOW YOUR SUBSCRIPTION AUTOMATICALLY RENEWS AND HOW TO CANCEL.

Overview

This website, oralucent.com (the "Site"), is operated by Oralucent, Inc., a Delaware corporation ("Oralucent," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site and all information, tools, features, and services offered through it (together, the "Service"), and your purchase of products and subscriptions from us.

These Terms incorporate by reference our Privacy Policy, Refund Policy, Shipping Policy, Guarantee & Warranty (the "Limited Warranty"), and any other policies we post on the Site and identify as part of these Terms. If these Terms conflict with a policy, these Terms control, except that the Limited Warranty controls as to product warranty coverage.

How you accept these Terms. You accept these Terms when you (a) place an order, (b) create an account, or (c) start a subscription, in each case after being presented with a link to these Terms. If you do not agree to these Terms, do not place an order, create an account, or use the Service.

Section 1 – Eligibility; United States Only

1.1 Age. You must be at least 18 years old and the age of majority where you live to place an order, create an account, or start a subscription. If you are under that age, you may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms.

1.2 United States only. The Service is intended for persons located in the United States. We sell and ship only to addresses in the United States. We make no representation that our products or the Service are appropriate or lawful for use outside the United States.

1.3 Account security. If you create an account, you are responsible for keeping your login credentials confidential and for activity under your account. Notify us promptly at customercare@oralucent.com of any unauthorized use.

Section 2 – General Conditions

2.1 We may refuse service to anyone for any lawful reason.

2.2 We use industry-standard encryption to protect information transmitted to and from the Site. Payment card information is processed by our third-party payment processors and is not stored by us. No method of transmission or storage is completely secure.

2.3 You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, or any content on the Site, without our express written permission.

2.4 Headings in these Terms are for convenience only and do not affect their interpretation.

Section 3 – Information on the Site

3.1 We work to keep information on the Site accurate and current, but we do not guarantee that all content is complete or up to date. Some content, such as blog articles and research summaries, may reflect information as of the date it was published.

3.2 We may modify the content of the Site at any time. We are not obligated to update content except as required by law. Nothing in this Section limits our responsibility for the accuracy of the product descriptions and claims we make about our own products.

Section 4 – Changes to the Service and Prices

4.1 Prices are subject to change. A price change does not affect an order we have already accepted. Price changes for active subscriptions are governed by Section 7.5.

4.2 We may modify, suspend, or discontinue the Service or any part of it. If we discontinue a product that is part of your active subscription, we will notify you and either offer a comparable replacement (which you may decline) or cancel the affected subscription and refund any amounts paid for undelivered shipments.

Section 5 – Products and Orders

5.1 Product information. We try to display product colors and images accurately, but we cannot guarantee that your screen displays them accurately. Product returns and refunds are governed by our Refund Policy and the Limited Warranty, including our 60-day Smile Guarantee.

5.2 Order acceptance. Your order is an offer to purchase. We accept your order when we ship it or send a shipping confirmation. We may refuse or cancel an order before acceptance, including for suspected fraud, pricing or product errors (see Section 15), or quantity limits. If we cancel an order after you have been charged, we will refund the full amount charged.

5.3 Quantity limits; resellers. We may limit or cancel quantities purchased per person, household, account, payment method, or shipping address. Our products are sold for personal use only. We may refuse or cancel orders that, in our reasonable judgment, appear to be placed by dealers, resellers, or distributors who are not authorized Oralucent retailers.

5.4 Shipping, title, and risk of loss. Shipping is governed by our Shipping Policy. We ship only to addresses in the United States.

5.5 Taxes. Prices do not include applicable sales tax, which is calculated at checkout based on your shipping address.

Section 6 – Billing and Account Information

6.1 You agree to provide current, complete, and accurate purchase and account information, and to promptly update it (including your email address and payment method) so we can complete your transactions, process subscription renewals, and contact you as needed.

6.2 By providing a payment method, you represent that you are authorized to use it, and you authorize us and our payment processors to charge it for your purchases, including recurring subscription charges under Section 7.

Section 7 – Subscriptions and Automatic Renewal

IF YOU START A SUBSCRIPTION, IT WILL AUTOMATICALLY RENEW AND YOUR PAYMENT METHOD WILL BE CHARGED AT EACH RENEWAL UNTIL YOU CANCEL. YOU CAN CANCEL ONLINE AT ANY TIME AS DESCRIBED IN SECTION 7.6.

7.1 What a subscription is. We offer subscriptions for certain products, such as replacement brush heads and O2 Whitening Gel, that ship automatically at the interval you select (each a "Subscription"). Before you start a Subscription, we will clearly show you, next to the request for your consent: (a) the products included; (b) the price you will be charged for each shipment, including any introductory or discounted price and the price that applies after it ends; (c) how often you will be charged and shipped; (d) that the Subscription continues until you cancel; and (e) how to cancel.

7.2 Your consent. We will not charge you for a Subscription unless you give your express, affirmative consent to these automatic renewal terms, separate from your acceptance of the rest of these Terms (for example, by checking an unchecked box). We keep a record of your consent.

7.3 Confirmation. After you start a Subscription, we will send you a confirmation by email that you can keep, describing the automatic renewal terms, the price and frequency of charges, and how to cancel.

7.4 Billing. By starting a Subscription, you authorize us and our payment processors to charge your payment method on file, at the start of each billing period, for the then-current price of the shipment plus applicable tax and shipping (if any). If a charge fails, we may retry it, pause your Subscription, or cancel it. We will notify you if your Subscription is paused or cancelled for non-payment.

7.5 Price and term changes. We will notify you by email at least 7 days and no more than 30 days before any change in the price of your Subscription or any other material change to its terms takes effect. The notice will explain the change and how to cancel. If you do not cancel before the change takes effect, the new price will apply to your next renewal. If you are charged a higher price and you cancel within 14 days after that charge, we will refund that charge (for a shipment that has already been delivered, upon return of the unopened products).

7.6 How to cancel. You may cancel a Subscription at any time, without charge or penalty, by: (a) using the cancel option in the subscription management portal in your Oralucent account, which is available at all times; or (b) emailing customercare@oralucent.com. We process cancellation requests received by email within one business day. We may present you with a one-time offer to keep your Subscription, but you can always decline it and complete your cancellation in the same session. We will send you an email confirming your cancellation.

7.7 Effect of cancellation. To avoid the next charge, cancel before your next billing date shown in your account. Cancellation stops future charges and shipments. Shipments already charged before you cancelled are governed by our Refund Policy and the Smile Guarantee.

7.8 Reminders. We will send you a reminder at least once a year describing your Subscription, the price and frequency of charges, and how to cancel. For any Subscription with a term of one year or longer, or any introductory or discounted offer that converts to a higher price, we will also send you a reminder before the renewal or price conversion, within the time periods required by applicable law.

7.9 Pausing and changes. You may skip a shipment, change your shipment frequency, or update your payment method in your account at any time before your next billing date.

7.10 Our right to cancel. We may cancel any Subscription at any time, for any reason or no reason, by notifying you by email. Cancellation takes effect on the date stated in our notice. After that date, we will not charge you or ship further products under that Subscription, and we will refund any amount you paid for shipments that have not yet shipped. Shipments already delivered remain covered by our Refund Policy and the Smile Guarantee. We will not use this right to avoid the price-change notice required by Section 7.5.

Section 8 – HSA and FSA Eligibility

8.1 Eligibility requires a provider's determination. Oralucent products may qualify for reimbursement or payment from a Health Savings Account (HSA) or Flexible Spending Account (FSA) only if (a) a licensed healthcare provider issues a Letter of Medical Necessity ("LOMN") for you, and (b) the product is included in your treatment plan. Whether a purchase qualifies is determined by your provider and your plan administrator, not by Oralucent.

8.2 No guarantee. We do not guarantee that any purchase will be eligible for HSA or FSA payment or reimbursement, or that a provider will issue an LOMN. You are responsible for obtaining any required documentation, for keeping your receipts and LOMN, and for complying with your plan's rules. If a payment from your HSA or FSA is later determined to be ineligible, you are responsible for resolving it with your plan.

8.3 No tax or medical advice. Information we provide about HSA and FSA eligibility is general information only, not tax, legal, or medical advice. Consult your plan administrator or a tax advisor about your situation.

Section 9 – Health Information and Product Use

9.1 Not medical or dental advice. Information on the Site, including the studies and articles in our Science and Oral Insights sections, is provided for general educational purposes. It is not medical or dental advice and is not a substitute for professional diagnosis or treatment. Oralucent products are not a substitute for regular dental checkups and professional care. Consult your dentist or physician if you have questions about your oral health.

9.2 Consult a professional before use in certain cases. Consult your dentist or physician before using our products if you have a medical or dental condition, are sensitive to light, are taking medications that increase sensitivity to light, or are pregnant.

9.3 Use as directed. Use Oralucent products only as directed in the Instructions for Use and warnings provided with the product and on the Site. Do not use a product that appears damaged or is not working properly, and do not modify or disassemble a product.

9.4 Reporting a problem. If you experience an injury, adverse reaction, or product malfunction, stop using the product and contact us at customercare@oralucent.com. We review every report we receive.

Section 10 – Limited Warranty; Authorized Sellers

10.1 Limited Warranty. Our products are covered by the Limited Warranty and 60-day Smile Guarantee described on our Guarantee & Warranty page, which is part of these Terms. Section 17 explains how other warranties are limited.

10.2 Authorized sellers. The Limited Warranty and Smile Guarantee apply only to products purchased new from Oralucent or from an authorized Oralucent retailer. A list of authorized retailers is available on request at customercare@oralucent.com. Products purchased from unauthorized sellers may be counterfeit, used, refurbished, or improperly stored, and are not covered.

Section 11 – Third-Party Services and Links

11.1 The Site uses and links to tools, services, and websites operated by third parties, such as payment processors, review platforms, marketing and analytics providers, and social media platforms ("Third-Party Services"). We do not control Third-Party Services and are not responsible for their content, products, or practices. Your use of a Third-Party Service is governed by that provider's own terms and privacy policy.

11.2 Questions or complaints about a third party's products or services should be directed to that third party. This Section does not limit our responsibility for products we sell to you.

Section 12 – Reviews, Comments, and Other Submissions

12.1 Your submissions. If you submit reviews, testimonials, photos, videos, comments, ideas, suggestions, or other content to us or through our review or social media partners ("Submissions"), you grant Oralucent a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute your Submissions, together with the name or username you submitted them under, in any medium. We are not obligated to keep Submissions confidential, pay for them, or respond to them.

12.2 Your responsibilities. You are responsible for your Submissions. Your Submissions must be truthful, reflect your own genuine experience, and not violate anyone's rights or any law. They must not contain unlawful, abusive, obscene, or defamatory material, another person's personal information, or malicious code. You may not impersonate anyone or mislead us or others about the origin of a Submission.

12.3 Moderation. We do not remove or suppress reviews because they are negative. We may moderate Submissions under our posted review guidelines, for example content that is unlawful, abusive, off-topic, contains personal information, is not related to a genuine purchase or experience, or violates these Terms.

12.4 Incentives and affiliates. Some reviewers and content creators may receive compensation, free products, or commissions through our affiliate or review programs. We require them to clearly disclose that relationship, and we do not condition any incentive on the review being positive.

Section 13 – Intellectual Property

13.1 All content on the Site, including text, images, graphics, logos, videos, and software, and the Oralucent name and marks, are owned by Oralucent or its licensors and are protected by intellectual property laws. Our products are protected by patents listed on our Patents page.

13.2 We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. This license does not include resale or commercial use of the Site or its contents.

13.3 Copyright complaints. If you believe content on the Site infringes your copyright, send a notice to our designated agent at customercare@oralucent.com or Oralucent, Inc., 55 Union Place, #175, Summit, NJ 07901, that includes the information required by 17 U.S.C. § 512(c)(3).

Section 14 – Privacy and Text Messages

14.1 Our collection and use of personal information is governed by our Privacy Policy.

14.2 If you sign up to receive text messages from us, Sections 14.2 through 14.10 apply to our text message program (the "SMS Program"). Consent to receive marketing text messages is not a condition of any purchase.

14.3 Consent. By providing your mobile number and opting in (for example, at checkout or through a signup form), you agree to receive recurring marketing and informational text messages from Oralucent at that number, including offers, product updates, cart reminders, and order and Subscription notifications. These messages may be sent using automated technology. You confirm that you are the subscriber or customary user of that number.

14.4 Frequency and charges. Message frequency varies. Message and data rates may apply. We do not send marketing messages before 8 a.m. or after 8 p.m. in your local time.

14.5 How to opt out. Reply STOP to any message to stop receiving texts. Replies such as END, CANCEL, UNSUBSCRIBE, QUIT, OPT OUT, or REVOKE also work, as does any other reasonable request, including an email to customercare@oralucent.com. We will send one message confirming your opt-out and will honor your request promptly and within the time required by law. Opting out of text messages does not cancel a Subscription; to cancel, see Section 7.6.

14.6 Help. Reply HELP to any message for assistance, or contact customercare@oralucent.com.

14.7 Carriers. Mobile carriers are not liable for delayed or undelivered messages.

14.8 Changed numbers. If you change or deactivate your mobile number, reply STOP from that number or notify us at customercare@oralucent.com so we do not send messages to the number's next user.

14.9 Privacy. We do not sell or share your mobile number or text message opt-in data with third parties for their own marketing purposes. Our service providers process this information only to operate the SMS Program on our behalf. Our Privacy Policy governs how we use it.

14.10 Disputes. Any Dispute relating to the SMS Program, including any claim under the Telephone Consumer Protection Act or a similar state law, is subject to Section 19.

Section 15 – Errors, Inaccuracies, and Omissions

15.1 Information on the Site may occasionally contain errors in product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct any error and update information at any time.

15.2 If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel any order for that product, including after you have submitted it, and we will refund any amount charged. If we discover the error after shipping, we will contact you before charging any difference.

Section 16 – Prohibited Uses

You may not use the Site or its content:

  1. for any unlawful purpose or to encourage others to act unlawfully;
  2. to violate any law or regulation;
  3. to infringe our intellectual property rights or those of others;
  4. to harass, abuse, threaten, defame, or discriminate against anyone;
  5. to submit false or misleading information;
  6. to upload or transmit viruses or other malicious code;
  7. to collect or track the personal information of others;
  8. to spam, phish, or pretext, or to scrape, crawl, or spider the Site by automated means without our written permission;
  9. to purchase products for unauthorized resale; or
  10. to interfere with or circumvent the security features of the Site.

We may suspend or terminate your access to the Site for violating this Section.

Section 17 – Disclaimers and Limitation of Liability

17.1 Product warranties. Products are covered only by the Limited Warranty described in Section 10. Except as stated in the Limited Warranty, and to the extent permitted by law, any implied warranties, including implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the duration of the Limited Warranty.

17.2 The Site. The Site and its content are provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties regarding the Site, and we do not warrant that the Site will be uninterrupted, timely, secure, or error-free.

17.3 Exclusion of certain damages. To the fullest extent permitted by law, Oralucent and its officers, directors, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, savings, or data, arising out of or relating to these Terms, the Service, or any product, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages.

17.4 Liability cap. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the Service, or any product will not exceed the greater of (a) the amount you paid us for the product or Subscription shipment giving rise to the claim, or (b) $100.

17.5 Exclusions. Nothing in these Terms limits or excludes our liability for (a) death or personal injury caused by our negligence or by a defective product; (b) fraud, gross negligence, or willful misconduct; or (c) any other liability that cannot be limited or excluded under applicable law.

17.6 New Jersey residents. If you reside in New Jersey, Sections 17.1, 17.3, and 17.4 do not limit any rights or remedies you have under the New Jersey Products Liability Act (N.J.S.A. 2A:58C-1 et seq.), the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.), or the New Jersey Punitive Damages Act (N.J.S.A. 2A:15-5.9 et seq.). All other provisions of these Terms apply to New Jersey residents.

Section 18 – Indemnification

You agree to indemnify and hold harmless Oralucent and its officers, directors, employees, and agents from any third-party claim, including reasonable attorneys' fees, to the extent arising from (a) your Submissions, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party. This Section does not apply to the extent a claim arises from our own negligence or misconduct.

Section 19 – Dispute Resolution; Arbitration Agreement; Class Action Waiver

19.1 Agreement to arbitrate. You and Oralucent agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any Subscription, or any product purchased from us, including the breach, termination, enforcement, interpretation, or validity of these Terms (a "Dispute"), will be resolved by binding individual arbitration, except as provided in Section 19.2. YOU AND ORALUCENT ARE EACH WAIVING THE RIGHT TO SUE IN COURT AND TO HAVE A JUDGE OR JURY DECIDE THE DISPUTE. Arbitration uses a neutral arbitrator instead of a judge or jury, is more limited than court, and is subject to very limited review by a court.

19.2 Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies and remains there, or (b) seek injunctive or other equitable relief in court to protect its intellectual property rights.

19.3 Informal resolution first. Before starting an arbitration, the party raising a Dispute must send the other a written notice describing the Dispute and the relief sought. Notices to us go to customercare@oralucent.com or the address in Section 24. Notices to you go to the email or address associated with your order or account. The parties will try in good faith to resolve the Dispute informally for 60 days, which may include an individual telephone or video conference. Statutes of limitation and filing-fee deadlines are tolled during this period.

19.4 Rules and procedure. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (available at adr.org), before a single arbitrator. Fees will be allocated as provided in those Rules. The hearing will take place by videoconference or in the county where you reside, unless the parties agree otherwise. The arbitrator may award any individual relief that a court could award, and must follow these Terms. Judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this Section 19.

19.5 Delegation. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this Section 19, except that a court will decide any dispute about Section 19.6 or Section 19.7.

19.6 Class action waiver. YOU AND ORALUCENT MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding, except as provided in Section 19.7. If this waiver is found unenforceable as to any claim or request for relief, that claim or request will be decided by a court (not in arbitration), after all individual arbitrable claims are resolved, and this Section 19 will otherwise remain in effect.

19.7 Mass filings. If 25 or more similar demands for arbitration are filed against Oralucent by or with the assistance of the same or coordinated counsel, the AAA Mass Arbitration Supplementary Rules will apply, and the demands may be administered in batches as those Rules permit. Each party will cooperate in good faith with the AAA to administer the demands efficiently.

19.8 Right to opt out. You may opt out of this Section 19 by emailing customercare@oralucent.com within 30 days after you first accept these Terms. Your email must include your name, mailing address, the email address associated with your order or account, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms or any arbitration agreement you may have with us under a separate agreement.

19.9 Changes to this Section. If we change this Section 19, the change will not apply to any Dispute of which we had written notice before the change takes effect. If you reject a change by emailing customercare@oralucent.com within 30 days after it takes effect, the prior version of this Section 19 will continue to apply to you.

19.10 Survival; severability. This Section 19 survives termination of these Terms and the end of any Subscription. Except as provided in Section 19.6, if any part of this Section 19 is found unenforceable, the remainder will be enforced.

Section 20 – Governing Law; Venue

These Terms are governed by the Federal Arbitration Act and, to the extent not preempted, the laws of the State of New Jersey, without regard to its conflict-of-law rules. For any Dispute that is not subject to arbitration, you and Oralucent consent to the exclusive jurisdiction of the state and federal courts located in Union County, New Jersey, except that you may bring a claim in the small claims court for the county where you reside. Nothing in these Terms deprives you of the protection of any law of your state of residence that cannot be waived by contract.

Section 21 – Termination

21.1 You may stop using the Service at any time. To end a Subscription, follow Section 7.6.

21.2 We may suspend or terminate your account or access to the Service if you materially violate these Terms or if we reasonably suspect fraud or misuse. If we terminate an active Subscription, we will notify you and refund any amounts paid for shipments not yet made.

21.3 Sections 8.2, 10, 12, 13, and 17 through 23, and any obligations incurred before termination, survive termination.

Section 22 – Changes to These Terms

22.1 We may update these Terms from time to time. We will post the updated Terms on this page and change the "Last Updated" date. Updated Terms take effect when posted and apply to use of the Service and purchases made after that date. They do not apply retroactively to orders placed before that date.

22.2 If we make a material change, we will give notice by email to account holders and active subscribers, or by a prominent notice on the Site, before the change takes effect. Changes affecting active Subscriptions are also subject to Section 7.5. Changes to Section 19 are subject to Section 19.9.

Section 23 – General Provisions

23.1 Entire agreement. These Terms, together with the policies incorporated by reference, are the entire agreement between you and Oralucent regarding the Service, and supersede prior versions of these Terms and any prior communications on that subject.

23.2 No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

23.3 Severability. Except as provided in Section 19.6, if any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

23.4 Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, or to an affiliate.

23.5 Events beyond our control. We are not responsible for delays or failures in performance caused by events beyond our reasonable control, such as natural disasters, carrier delays, labor disputes, supply shortages, or governmental action. If such an event delays a Subscription shipment by more than 30 days, you may cancel and receive a refund for that shipment.

23.6 Electronic communications. You consent to receive communications from us electronically, including order confirmations, Subscription notices, and notices under these Terms, at the email address you provide. Electronic communications satisfy any requirement that a communication be in writing.

23.7 Interpretation. The words "including" and "for example" mean "including without limitation." No provision of these Terms will be construed against either party on the basis of authorship.
